Can I get UK citizenship by descent through my father or mother?

Becoming a British citizen is the dream of millions of honest hardworking people across the globe. It is a land ripe with possibility and perfect for raising a family in safety. This makes Britain the destination of choice for not only skilled individuals, but also those whose heritage can be traced to its shores. This prompts would-be candidates to take a closer look at their family trees in an attempt to find out what claim, if any, they have for a UK citizenship by descent.

What does it mean to qualify for UK citizenship by Descent?

Put simply, any individual born outside of the UK and who has a legitimate claim to becoming a
British national could apply for uk citizenship by descent. This would mean applying for a passport through either one of your parents. U.K.ABROAD has years of experience in dealing with these cases and will professionally assist you to get your passport.

The idea of applying for UK citizenship in such a manner can seem like a frightening endeavour for anyone. Especially when you are unfamiliar with the myriad of legalities and red-tape associated with such an application. Do not be discouraged. The team at U.K.ABROAD are here to streamline the process and answer any questions you may have.

Please note that if you are born after the 01 January 1983 that there is no such option to apply for
British citizenship through Double Descent.  Also, if both you and the British parent you are applying through were born outside of the UK, your chances of acquiring a passport by descent become less likely.

If you feel that you have extenuating circumstances and would like a professional opinion on the matter, please contact us here: https://www.ukabroad.net/contact-us/. We will help you to understand exactly where you stand in your bid for citizenship by descent.

There are a multitude of different aspects to consider when applying. However the main factor that must be considered is whether you are applying through your British born mother, or British born father. You may be under the impression that there is no difference, but when it comes to the parent through whom you are applying, there are some distinct differences.

The main difference is that the dates to which you must adhere and which make your application valid, are not the same:

  • Descent through a British born mother: Applicant was born before/after 1 January 1983
  • Descent through a British born father: Applicant born before/after 1 July 2006

Please take a look below at the different breakdowns of each possible method:

Descent through British born Mother

Applicant born before 1 January 1983 – British law requires that an applicant’s birth needs to be
registered with the British authorities before applying for a first-time passport, IF the applicant
was born outside the United Kingdom before 1 January 1983, born to a British born (or naturalized) mother, and never had a British passport before.

Applicant born after 1 January 1983 – Birth registrations are NOT applicable IF the applicant was born outside the United Kingdom AFTER 1 January 1983, born to a British born (or naturalized) mother. Therefore the applicant is eligible for a British passport without registering his/her birth.

IF born before 1 January 1983, then the following two scenarios are applicable:
Scenario 1:
Applicant’s birth was registered with the British authorities; applicant has an original British birth registration certificate.
Therefore the applicant’s first-time British passport application can be finalized with immediate
effect.

Scenario 2:
Applicant’s birth was never registered with the British authorities – the applicant can become a
British citizen by registration before applying for a first time British passport.
* U.K.ABROAD is able to assist with the birth registration process.

Descent through British born father

Applicant born before 1 July 2006 – British law requires that an applicant’s birth needs to be
registered with the British authorities before applying for a first-time passport, IF the applicant
was born outside the United Kingdom before 1 July 2006, born to a British born (or naturalized)
father and the applicant’s parents were not married at any point.

Applicant born after 1 July 2006 – Birth registrations are NOT applicable IF the applicant was born outside the United Kingdom AFTER 1 July 2006, born to a British born (or naturalized) father.
Therefore the applicant is eligible for a British passport without registering his/her birth.
IF the applicant was born before 1 July 2006, then the following two scenarios are applicable:
Scenario 1:
Applicants parents are/were married at any point, before or after applicant’s birth, therefore the
applicant’s first-time British passport application can be finalized with immediate effect.

Scenario 2:
Applicant’s parents were never married – the applicant can become a British citizen by registration
before applying for a first-time British passport.

* U.K.ABROAD is able to assist with the birth registration process.

It is important to know that when you submit your application directly to Her Majesty’s Passport

incorrectly, or are not accompanied by the necessary supporting documents, can mean huge delays.

In more severe cases this can even result in the application being rejected outright. Fees are non-
refundable and nobody wants to pay the exorbitant passport fees, twice.

There is no reason to stress. Get in touch with U.K.ABROAD and we will give you the best
opportunity for a successful application. From start-to-finish, we will guide you and make the
process as easy and hassle-free as possible.

Don’t let the fear of the process get in the way of you dream of attaining your passport. If you
qualify to obtain a passport via ‘citizenship by descent’, you owe it to yourself and family to make
the right choice for your future.
